Attorney Terms
These Attorney Terms apply to attorneys who receive and accept requests through Lawber. They add to the Terms of Service; where the two differ for attorneys, these Attorney Terms apply. Lawber is operated by StopScam LLC, 254 Chapman Road, Ste 208, Newark, DE 19702, US (“we”, “us”). You can reach us at [email protected].
1. Who can accept requests
- You must be an attorney licensed and in good standing in the state where you provide the service, and allowed to provide the type of service requested.
- To apply to accept requests, provide your legal name, state of license and bar number. Lawber staff verify your license identifiers and current eligibility against official sources unless your application qualifies for automatic approval, described below. A supporting license document is optional.
- Personal identity for new applications is verified only through the Stripe Identity hosted government-ID and selfie check. Stripe checks the document and compares the selfie with its photo. Lawber does not offer direct ID/selfie uploads as an alternative. Lawber's integration does not download or store Stripe-collected raw ID/selfie files or biometric templates; Lawber keeps limited verification references, outcomes and necessary verified names. Authorized staff may view the Stripe verification result and records in its Dashboard for license review and compliance. Staff do not perform the identity check. Optional license documents and historical documents previously uploaded to Lawber remain retained under our retention policy. If the identity check is temporarily unavailable, you can try again later in the app.
- Review Stripe's Privacy Policy and the disclosures and choices Stripe presents. Accepting these Attorney Terms does not replace any biometric-processing or training consent Stripe presents. Provider retention settings and disclosures apply to Stripe's records; see the Lawber Privacy Policy for our separate records and privacy-request options.
- Automatic approval. An application is approved automatically only when all of these hold: your Stripe Identity check is verified; your state is one that Lawber checks automatically through its official registry; a check of the official registry made within the last 24 hours shows your license as active and eligible with no discipline; the name verified by Stripe and your bar number exactly match that record; and your application has not been changed, resubmitted or rejected before. Every other application is reviewed by a person at Lawber. An AI tool may help staff search public registries, but AI never approves an application.
- An identity result, a license upload or a connected payout account does not by itself establish your current right to practice. For applications that are not approved automatically, Lawber staff separately review current official state-bar evidence and the identity/name match before approving.
- An approval is valid for a limited period shown in the app (for an automatic approval, up to one year, or until your license expires if that is earlier) and must then be renewed. The app won’t let you accept a request that starts after your approval or license expires.
- We check approved licenses again periodically against official registries. If a registry shows your license as inactive, suspended or otherwise not in good standing, you can’t accept new requests until our team reviews it; requests you already accepted are not canceled automatically, and staff decide on them.
- Tell us right away through Support if your license status changes, including suspension, discipline or restrictions.
- To receive payouts, you connect a Stripe account (Stripe Connect Express) and keep it in good standing.
- Once you are approved, clients see a “Verified” badge on your profile.
2. Your independence and professional duties
- You are an independent professional, not an employee, partner or agent of Lawber. Lawber does not direct or control your legal work or judgment, and Lawber does not take any part of your fee.
- You are responsible for complying with the rules of professional conduct of your jurisdiction, including conflict checks, confidentiality, competence and communication with the client, and any rules that apply to the way you receive requests and fees.
- The scope of your representation is agreed between you and the client. If your rules require a written engagement or a limited-scope agreement, you arrange it with the client.
- You are responsible for any insurance, registrations and taxes that apply to your practice.
3. Receiving and accepting requests
- You see requests within your work radius and are notified about new requests near you. Urgent requests are offered to you only if you turn on “Accept urgent requests” and confirm that you can react quickly. Until you are approved, you can see a limited preview of requests but can’t accept them.
- Before accepting, check that you can arrive in time and that you can do the task. If the task requires the client to be present, say so when accepting: the client is asked to confirm, and the request is assigned to you only after the confirmation.
- Accepting a request is a commitment to arrive in the arrival window shown in the app.
- To keep service reliable, the app limits how many requests you can hold: 3 in any 7 days at first, 6 after 5 completed requests and 10 after 20; at most 3 requests within 12 hours of each other; and no overlapping requests (a service is counted as 2 hours plus travel time).
- Clients can see on their map the approximate area (within about 2 km) of approved attorneys nearby, based on your saved profile location, without your name.
4. Before the service day
- Before the service day, the client sees your photo, state of license, languages and number of completed Lawber requests, but not your name. Messages and calls open on the service day at 12:00 AM local time at the place of the service (for an urgent request — right away).
- If you can’t take a request after accepting it, withdraw in the app as early as possible:
When you withdraw What happens 48 hours or more before the start The request returns to other attorneys. No consequences. 12 to 48 hours before You stay assigned until a replacement accepts. Your account is limited for 7 days. 2 to 12 hours before As above, plus a 6-hour pause on new requests. Less than 2 hours before As above; limited for 30 days and a 12-hour pause. A second late withdrawal while a limit is active Your account is paused for 14 days. - While a replacement is being sought, the client can cancel free of charge. If no replacement accepts by the deadline, the request closes and the client’s hold is released.
- If the client cancels after you accepted and before you arrive — an urgent request at any time, or a scheduled request less than 24 hours before the start — you receive 50% of your call-out for the request as an earning, paid under the payout rules in section 6.
5. The service day
- When you mark “Arrived” and when you mark “Completed”, the app records one location point from your device (coordinates, accuracy and time) as part of the service record. It is not tracking: no route or other points are kept. If location is off or unavailable, the action still works and the record says the location was unavailable. Staff use these points to review disputes, and they are sent to Stripe as evidence if the client disputes the charge with their bank.
- Mark “Arrived” only when you are actually at the place. The arrival window opens 60 minutes before a scheduled start and closes 30 minutes after it; for an urgent request you must arrive within 60 minutes of the first acceptance (or by the time shown).
- If you don’t mark arrival by the deadline, the request is canceled because the attorney did not come: the client’s hold is released, nothing is paid and your account receives an automatic reliability strike (section 7). If you were there and provided the service but couldn’t record arrival, use “Report service provided” in the request while the client’s hold is active; Support then reviews the request before the hold expires and your payout waits for the decision.
- Marking arrival when you are not there is a serious breach. If Support confirms a false arrival, nothing is paid for it and your account may be suspended.
- The price of a request covers preparation, travel and up to 60 minutes at the place, including waiting. No additional amount is charged through Lawber for longer service.
- When the service is over, mark “Completed” and choose what happened: service provided (and what you did), hearing postponed or canceled, or client didn’t show. If a pre-consultation was ordered, say whether it took place; if not, its price is not charged. A pre-consultation actually provided and confirmed through the consultation-only court-postponement process may be settled separately, as described in the client Terms.
- If you finish before the scheduled start, confirm that you finished early. The client is asked to acknowledge it before any charge; if the client does not answer or disagrees, Support decides.
- “Client didn’t show” is available only when the client’s presence was agreed as required, after waiting at least 30 minutes from the later of the agreed meeting time and your arrival, and after trying to contact the client in the app.
- If after arriving you can’t continue (for example, because of illness or an emergency), report it in the app with the reason and what has been done. Tell the court or other participants what your professional rules require. Lawber Support then decides on a replacement and on payment for the part you completed.
- Sharing your live location with the client on the service day is optional: you can share it for 15 minutes or one hour and stop at any time.
- You can message and make audio or video calls with the client in the app. Calls are not recorded. When the request is completed or canceled, the conversation becomes read-only.
6. Payment and payouts
- The client pays through Lawber. The client’s price consists of your fee (call-out, including any urgent surcharge and evening or night rate; a pre-consultation if held; and any Boost the client added) and Lawber’s service fee, which the client pays for the platform. Your payout is the agreed attorney-service amount, excluding Lawber’s service fee and any unprovided or refunded attorney-service components. The app shows you your own amount for each request. Coupon discounts are paid by Lawber and don’t reduce the agreed attorney-service amount. Even a 100% coupon leaves the client’s Lawber service fee payable.
- If the hearing is postponed or the client doesn’t show after you arrived, you are paid in full (except a pre-consultation that didn’t take place).
- Accepting a request alone does not charge the client’s card. The normal charge follows the authorized service-completion process. If confirmed billable arrival has occurred but completion remains unresolved, the authorized amount may be charged six hours before the actual confirmed bank capture deadline, excluding known unprovided components and a false arrival confirmed by Support. This backup charge is pending review, not a finding that all services were delivered; your payment remains paused until Lawber Support reviews it and the other payout conditions are met. A late report you send in the app is considered in that review.
- Payouts are sent to your Stripe account no earlier than 72 hours after the funds for your payout become available in Lawber’s Stripe platform balance. A card charge alone does not start that period. The transfer is automatic unless the request was disputed or automatic transfers are turned off for your account; otherwise it is made after review. Stripe then pays your Stripe balance out to your bank account on your Stripe account’s payout schedule, which Lawber sets to weekly, on Mondays; the schedule is managed by Lawber, and you can change your bank account or debit card in Stripe at any time.
- If the client opens a dispute, the payout waits for Support’s decision. When your arrival and completion were recorded, Support pays you unless there is evidence that the service was not provided as agreed. A refund for your service reduces your payout for the refunded part of the service. A refund of Lawber’s service fee, or a goodwill credit that Lawber pays to the client, does not reduce your payout.
- After you complete a request, the client is asked to confirm the service or report a problem within 24 hours; no answer in that time counts as accepted. If the client disputes a charge with their bank (a chargeback), we send Stripe facts from the service record of the request as evidence — the timeline, your arrival and completion location points, the client’s confirmation, the number and times of messages and calls, never their content — and your payout for that request waits. If the chargeback is lost, your share is taken back only if your arrival was not recorded or Support finds you at fault; otherwise Lawber bears the loss.
- An amount you owe to Lawber — for example, after a dispute decision or a lost chargeback that could not be taken back from a transfer — is deducted from your next payouts. While you owe an amount, transfers are made after review instead of automatically. You can see deductions in your Wallet.
- If another attorney replaces you after you arrived, Lawber Support decides how much of the payment is due for the part you completed; that amount is paid by Lawber.
- Arrange and receive payment for requests you got through Lawber only through Lawber.
7. Reliability
- Your account status can be normal, limited (a lower number of requests), paused (no new requests; you finish the ones you have) or suspended (no new requests; future requests are reassigned).
- Late withdrawals are handled as shown in section 4.
- Strikes. A missed arrival (section 5), or Lawber Support canceling a request because you could not attend, gives your account an automatic strike. The first strike within 90 days brings a warning and limits your account for 7 days; a second strike within 90 days pauses it for 14 days.
- Appeals. You can appeal a strike in the app within 7 days, with an explanation and evidence. A person at Lawber reviews the appeal. If the strike is overturned, its restriction is lifted.
- A no-show confirmed by Support after a complaint pauses your account for 14 days; a second one within 90 days leads to suspension. Two reliability complaints at the same time pause new requests until they are reviewed.
- A suspension is lifted only by a person at Lawber after review. Quality complaints (for example, about communication) are reviewed individually.
- Clients can rate completed requests. Ratings are visible only to Lawber staff and do not automatically affect your requests or payouts.
8. Problems and disputes
- Before the charge, the client can report a problem and the ordinary charge waits for Support’s review. The narrow authorized backup charge described in section 6 may still occur for confirmed billable arrival with unresolved completion before the actual bank capture deadline; your payout remains paused for review. After the charge, you or the client can open a dispute within 24 hours.
- You can add information to an open review in the app and should answer Support’s questions. Opening a review does not itself give staff access to confidential request conversations. In-app reviewer access requires the client’s separate permission for a named reviewer and the selected conversation snapshot and attachments; that access ends when permission is withdrawn or the dispute closes.
- Support may decide on a full or partial refund to the client or on payment to you, and may apply the reliability measures above.
9. Client information
- Use client information you receive through Lawber only to provide the requested service and as your professional rules require, and protect it accordingly.
- The AI brief is a summary made by an AI model from the client’s information. It can contain mistakes; check the facts with the client.
- The client’s location and details are shared with you for the request only. Don’t contact clients through Lawber for other purposes.
10. Ending participation
- You can stop accepting requests at any time. Requests you already accepted must be completed or withdrawn as described above.
- We may limit, pause or end your access if you no longer meet the requirements, break these Attorney Terms or the Terms of Service, or put clients at risk. Payments for completed work are handled as described in these Attorney Terms.
- You can delete your account as described in the Privacy Policy; open requests, disputes and payouts are finished first.
11. Changes and contact
- We may update these Attorney Terms. Each version is identified at the top of this page. When we publish a new version, the app asks you to accept it before you see or accept new requests. A request is governed by the version in effect when you accepted it.
